Janzen Schroeder Agricultural Law LLC (“Janzen Ag Law”) is committed to protecting the privacy of visitors of the Janzen Ag Law websites, which includes www.aglaw.us and www.janzenaglaw.com (collectively, these are referred to as the “Website” in the Privacy Policy). This policy describes the types of personal information the Website may collect from you when you visit. 

The Personal Information the Janzen Ag Law Website Collects. When browsing the Website, there are two types of information that the Website may collect (“Personal Information”): 

  • Information You Provide Voluntarily:  This includes information that can be used to identify a person, including name, address, phone number. The Website does not collect Personal Information unless voluntarily provided by you.

  • Information Collected Automatically: The Website collects information about how you are accessing the Website, such as IP address, general location, pages visited, frequency of visits, referring website, and similar information about how you use the Website. The Website uses cookies and other tracking technologies to collect some of this information. You can set your browser to opt-out from using cookies.

How Janzen Ag Law Uses Your Information. Janzen Ag Law uses Personal Information you provided voluntarily to respond to Website inquiries and for marketing purposes. For example, if you sign up to receive the monthly E-Newsletter, Janzen Ag Law will use your name and email address to send you a monthly E-Newsletter. Janzen Ag Law reviews browsing information collected automatically to improve the functionality and content of the Website. 

Janzen Ag Law does not share your Personal Information with Third-Parties. 

Use of Third-Party Vendors. Janzen Ag Law uses Squarespace to host the Website.  As the website host, Squarespace may have access to your Personal Information. Janzen Ag Law uses Google Analytics to learn more information about how visitors use the Website, such as referring website, search terms used, time spent on the Website, and similar information. Janzen Ag Law does not provide any Personal Information to Google that you provided voluntarily through the Website. Please consult Squarespace and Google's privacy policies for more information. Your personal information may be used by third-party contractors employed by Janzen Ag Law for marketing services, but those contractors are bound by this Privacy Policy.

Your Privacy Rights. Janzen Ag Law provides Website visitors the following privacy rights, to the extent reasonably possible, following an email request to info@aglaw.us:

  • To correct your Personal Information.

  • To delete your Personal Information.

  • To object to processing of your Personal Information. 

Security. Janzen Ag Law takes reasonable measures to protect Personal Information from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the Personal Information. 

Retention of Personal Information. Janzen Ag Law retains Personal Information where there is an ongoing legitimate business or legal need to do so. When there is no ongoing legitimate business need to process your Personal Information, Janzen Ag Law will either delete or anonymize your Personal Information. 

Specific Laws that May Apply to Collection of Personal Information. Janzen Ag Law is an Indiana limited liability company. To the greatest extent possible, Indiana law applies to your privacy rights. Depending on various factors, other state or federal laws may apply to your use of the Website. 

  • Privacy Rights of Children.  Janzen Ag Law does not knowingly solicit, collect, or store the Personal Information of children under the age of 16. Please do not submit any Personal Information of a child under the age of 16 to Janzen Ag Law. If you are under the age of 16, please do not use the Website or submit Personal Information to Janzen Ag Law. Janzen Ag Law will delete any Personal Information discovered of any child under the age of 16.

  • California Residents.  If you reside in California, you may have the right to: (1) Request that a business that collects a consumer's personal data disclose the categories of personal information that a business has collected about consumers; (2) Request that a business delete any personal information about the consumer that a business has collected; and (3) Request that a business that sells a consumer's personal information, not sell the consumer's personal information.

  • European Union Residents. Janzen Ag Law does not intentionally collect information about European Union residents. If you are a European Union resident and you believe Janzen Ag Law has improperly collected your Personal Information, please email info@aglaw.us and request that your Personal Information be deleted. 

Payment Processors. Janzen Ag Law uses LawPay and Clio to process payments from clients (“Payment Processors”). Janzen Ag Law does not retain financial information required by these Payment Processors, such as credit card information. Use of Payment Processors’ websites to make payment to Janzen Ag Law is subject to the respective Payment Processors’ privacy policy and other agreements.  

Modifications.  Janzen Ag Law may update this Privacy Policy at any time. All updates and amendments are effective immediately when you visit the Website.  

Miscellaneous Legal Terms.  This Privacy Policy is governed by Indiana law. Any suit naming Janzen Ag Law (including any affiliated company or brand, owners, employees, attorneys, or agents) as a party involving this Privacy Policy must be filed in the state courts or federal district court located in Indianapolis, Indiana, and you consent to venue and jurisdiction there. Janzen Ag Law’s failure to enforce any provision in this Privacy Policy is not a waiver of the right to do so at a later date. If any provision is found unenforceable, the remaining provisions of the Privacy Policy will remain in full effect.  

Janzen Ag Law Clients. This Privacy Policy is intended to explain the basic privacy rights of Website visitors. Visiting the Website does not establish an attorney-client relationship. Clients of Janzen Ag Law are afforded additional privacy rights as provided in a specific engagement letter, standard terms of engagement, and the Indiana Rules of Professional Conduct for attorneys.
